Throughout this document, “Nua’s Studio”, “we”, “us”, and “our” refer to the registered business stated above.

By accessing this website and completing a purchase, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms & Conditions and our Shopping Guide & Store Policy.

1. Binding Agreement

By purchasing, the buyer enters into a legally binding agreement with Nua’s Studio.

No exceptions shall be made outside the terms stated herein unless confirmed in written form by Nua’s Studio.

Failure to read these terms does not exempt the buyer from being bound by them.

2. Nature of Goods – Preloved & Used Items

Nua’s Studio specializes in preloved, used, and second hand musical instruments and equipment.

All preloved items are sold strictly on an “as is” and “as described” basis.

Buyer acknowledges and agrees that:

• Items may show signs of wear, cosmetic imperfections, aging, or prior usage
• Cosmetic condition does not affect functionality unless explicitly stated
• All photos and descriptions form part of the item condition disclosure
• Buyer accepts the condition in full at the time of purchase

Claims based on cosmetic dissatisfaction, personal expectations, or subjective evaluation shall not be considered valid grounds for return, refund, or dispute.

3. Used Electronics Lifespan Limitation

All used electronic products are tested and verified functional prior to sale.

Warranty coverage is strictly limited to the periods stated in Section 15.

Beyond the stated warranty period, no guarantee of lifespan or durability is provided.

Electronic components naturally degrade over time and may fail without warning due to aging, environmental factors, or prior use.

By purchasing, buyer acknowledges acceptance of this limitation.

4. Subjective Sound and Performance Disclaimer

Sound quality, tonal characteristics, and performance perception are subjective and influenced by multiple external factors including but not limited to:

• Amplifiers
• Signal chain
• Playing technique
• Environment
• Settings and configuration

Dissatisfaction based on tonal preference, feel, or subjective expectation shall not be considered a defect.

Such claims shall not qualify for refund, return, or dispute.

5. Buyer Responsibility and Due Diligence

Buyer is solely responsible for:

• Reviewing product description and photos
• Asking questions prior to purchase
• Ensuring compatibility with their equipment
• Ensuring voltage compatibility in their country

Completion of purchase confirms buyer’s full acceptance.

6. Payment Finality

All payments made are final and non reversible except where explicitly provided under our return policy.

Buyer agrees not to initiate unjustified payment disputes or chargebacks.

Fraudulent disputes shall constitute breach of agreement.

7. Chargeback and Payment Dispute Enforcement

In the event of a payment dispute or chargeback, buyer expressly authorizes Nua’s Studio to submit all relevant evidence including:

• Proof of shipment
• Courier delivery confirmation
• Customer communications
• Website product listing
• Payment records
• IP address and fraud screening data

Nua’s Studio reserves the right to pursue recovery of financial losses, administrative costs, and damages resulting from fraudulent disputes.

Fraudulent disputes may result in permanent blacklist and legal escalation.

8. Shipping, Delivery and Risk Transfer

Ownership and risk transfer to buyer immediately upon handover to courier.

Nua’s Studio shall not be liable for:

• Courier delays
• Mishandling by courier
• Loss after delivery confirmation
• Customs delays or customs actions

Buyer assumes full responsibility upon shipment.

9. International Buyers and Customs Responsibility

International buyers assume full responsibility for:

• Import duties
• Taxes
• Customs compliance
• Import restrictions

Failure to accept delivery or clear customs does not qualify for full refund.

All associated costs shall be borne by buyer.

10. Trade In Legal Protection

By trading in equipment, customer legally represents and warrants that:

• They are the lawful owner
• Item is not stolen
• Item is free from financial encumbrance
• All disclosed information is accurate

Trade in transactions are final, binding, and irreversible.

Fraudulent trade ins may be reported to authorities.

11. Setup Service Liability Limitation

Setup services are performed based on instrument condition at time of service.

Buyer acknowledges that wood instruments naturally shift due to environmental factors.

Nua’s Studio shall not be liable for post service environmental changes affecting playability.

12. Technical Support Limitation

Nua’s Studio is under no obligation to provide ongoing technical support beyond reasonable pre sale clarification.

Extended technical assistance may be declined or subject to service fees.

13. Limitation of Liability

Maximum liability shall not exceed the original purchase price.

Nua’s Studio shall not be liable for:

• Indirect losses
• Consequential losses
• Loss of business
• Loss of opportunity
• Emotional dissatisfaction
• Future product failure

14. Fraud Prevention and Rights Reserved

Nua’s Studio reserves the right to:

• Refuse service
• Cancel orders
• Refuse refunds
• Report fraud
• Blacklist abusive customers

at our sole discretion.

15. Warranty Policy

15.1 Limited Warranty Coverage

Nua’s Studio provides limited warranty coverage under the following conditions:

A. Electric Guitars and Electric Bass Guitars

Warranty Period: 30 days from date of delivery
Coverage: Electronic components only

Covered components include:

• Pickups
• Selector switches
• Potentiometers
• Output jack
• Internal wiring faults

This warranty does not cover:

• Cosmetic condition
• Fret wear
• Neck movement
• Wood cracks
• Finish issues
• Setup preference
• String condition
• Oxidation or aging hardware
• Damage caused by humidity or environment
• Damage from modification, rewiring, or third party repair

B. Amplifiers and Pedals

Warranty Period: 7 days from date of delivery
Coverage applies only to functional electronic failure not caused by misuse.

This warranty does not cover:

• Tube wear or tone preference
• Cosmetic wear
• Scratchy pots due to oxidation
• Power supply misuse
• Incorrect voltage usage
• Damage from wrong adapter
• User configuration error
• Tone dissatisfaction

C. All Other Items

All other products are sold strictly as is unless explicitly stated in the product description.
No warranty applies.

15.2 Warranty Claim Conditions

To qualify for warranty:

• Claim must be reported within the warranty period
• Clear video proof must be provided
• Item must not be opened, modified, or repaired by third parties
• Serial numbers and internal components must remain original

Failure to meet these conditions voids warranty.

15.3 Warranty Resolution

Nua’s Studio reserves the sole right to determine:

• Whether issue qualifies under warranty
• Whether repair, replacement, or partial refund is appropriate
• Whether item must be returned for inspection

Return shipping for warranty inspection may be required.

Warranty does not include refund for buyer preference, tone expectation, or change of mind.

16. Governing Law and Jurisdiction

This agreement shall be governed exclusively by the laws of Malaysia.

Buyer agrees to submit to the exclusive jurisdiction of Malaysian courts.
